Directive (EU) 2020/2184 of the European Parliament and of the Council of 16 December 2020 on the quality of water intended for human consumption
Article 11: Which products are concerned
- Products intended for use in new installations or in existing installations
- Use of these products: the extraction, treatment, storage or distribution of water intended for human consumption and which comes into contact with such water
- Water intended for human consumption: water intended for drinking, cooking, food preparation, or other domestic purposes in public and private premises
The approval process
The approval process varies depending on the Risk Group or Product Group. The main items in the list below, which do not apply to all groups, include:
- Verification of the formulation in accordance with the new European positive lists (Delegated Act 2024/367)
- Inspection of production sites
- Migration tests at different temperatures and with various types of water to verify parameters required by Delegated Act 2024/368
- Verification of non-intentionally added substances using Gas Chromatography–Mass Spectrometry
- Verification of relevant substances
- Assessment of microbial growth potential
- Annual inspection and partial retesting
Entry into force and transitional period
Starting in 2027, products entering the EU market must be compliant. Compliance must be certified by an accredited and notified body according to this Directive. Notifications have not yet been assigned.
The Directive provides that each individual Member State may benefit from a transitional period, with duration determined by each country, but no later than 2032. This allows products approved under national legislation before 31 December 2026 to continue circulating within the territory of that country for the established period.
